ASSOCIATION OF PICKLEBALL PLAYERS (APP) TICKETING TERMS, CONDITIONS, AND PARTICIPATION WAIVER

Each ticket is a revocable, non-transferable license that grants the holder (“Holder”) admission to an Association of Pickleball Players (“APP”) event, including all matches, exhibitions, practices, fan experiences, clinics, open play sessions, recreational play, sponsor activations, and all other ancillary activities (collectively, the “Event”) at the designated venue (the “Venue”). Certain tickets may include or provide access to participation in pickleball activities. By purchasing, accepting, or using a ticket, Holder acknowledges and agrees that such ticket may permit participation in physical activities and that the terms set forth herein apply to both attendance and participation.

This license may be terminated at any time by APP, the event operator, the Venue, or their respective affiliates (collectively, the “Event Entities”), with or without cause.

Admission may be refused or revoked, and Holder may be ejected without refund, in the sole discretion of the Event Entities for any reason, including violation of Event policies or applicable law. Event dates, schedules, programming, player participation, and access to specific activities are subject to change without notice. Lost, stolen, or damaged tickets will not be replaced. No refunds or exchanges will be provided except as required by law or expressly determined by APP.

By purchasing, accepting, or using a ticket, and by entering the Venue or participating in any Event activity, Holder agrees to the following on behalf of themselves and any minor accompanying them:

ASSUMPTION OF RISK AND PARTICIPATION WAIVER

Holder understands and acknowledges that attendance at the Event and participation in pickleball-related and other activities involve inherent, known, and unknown risks that may result in serious bodily injury, illness, permanent disability, or death. These risks include, without limitation: being struck by pickleballs, paddles, or other equipment; collisions with players, instructors, staff, or other participants; physical exertion; slips, trips, and falls; facility conditions; equipment failure; negligent or intentional acts of other attendees; and exposure to communicable diseases.

Holder further acknowledges that participation in any pickleball activity (including clinics, open play, demonstrations, or recreational play) is voluntary, may occur in close proximity to other participants, and involves active physical engagement that increases the risk of injury.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOLDER VOLUNTARILY ASSUMES ALL RISKS ASSOCIATED WITH BOTH ATTENDANCE AT AND PARTICIPATION IN THE EVENT, WHETHER AS A SPECTATOR OR PARTICIPANT, AND WHETHER SUCH RISKS ARE KNOWN OR UNKNOWN.

HOLDER HEREBY RELEASES, WAIVES, AND DISCHARGES THE APP, THE EVENT ENTITIES, THE VENUE, PARTICIPATING PLAYERS, COACHES, INSTRUCTORS, SPONSORS, VENDORS, BROADCASTERS, AND THEIR RESPECTIVE AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND VOLUNTEERS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, OR EXPENSES ARISING OUT OF OR RELATED TO HOLDER’S ATTENDANCE AT OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF ANY RELEASED PARTY, TO THE FULLEST EXTENT PERMITTED BY LAW.

THIS RELEASE EXPRESSLY INCLUDES, WITHOUT LIMITATION, CLAIMS ARISING FROM ACTIVE PARTICIPATION IN PICKLEBALL OR RELATED ACTIVITIES CONDUCTED AT THE EVENT.

THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

HOLDER REPRESENTS THAT THEY ARE PHYSICALLY CAPABLE OF PARTICIPATING IN ANY ACTIVITIES THEY ELECT TO ENGAGE IN AND ASSUME FULL RESPONSIBILITY FOR THEIR PARTICIPATION. HOLDER UNDERSTANDS THAT THE RELEASED PARTIES DO NOT PROVIDE MEDICAL INSURANCE AND ARE NOT RESPONSIBLE FOR ANY MEDICAL COSTS INCURRED.

ARBITRATION AND WAIVER OF JURY TRIAL

Any dispute, claim, or cause of action arising out of or relating to the Event, this ticket, or Holder’s attendance or participation shall be resolved by final and binding confidential arbitration administered by JAMS under its commercial arbitration rules. The arbitration shall take place in the state where the Event is held unless otherwise determined by APP. Holder and the Event Entities waive any right to a jury trial and agree that claims may not be joined or consolidated with those of any other party. APP reserves the right to seek injunctive or equitable relief in a court of competent jurisdiction for protection of intellectual property or confidential information.

CONTENT AND RECORDING RESTRICTIONS

Holder may capture photographs and short video clips solely for personal, non-commercial use and only in accordance with posted Event policies. Live streaming, real-time transmission, or dissemination of match data, scoring information, or audiovisual content is strictly prohibited.

Holder may not use, distribute, license, sell, or otherwise exploit any content captured at the Event for commercial purposes, media distribution, or in connection with gambling or wagering activities. All rights in and to the Event and all related content are owned by APP or its licensors. To the extent Holder acquires any rights in such content, Holder assigns all such rights to APP.

PUBLICITY RELEASE

Holder grants to APP and its designees the irrevocable, perpetual, worldwide right to use Holder’s name, image, likeness, voice, and appearance (and that of any accompanying minor) captured in connection with the Event in any media now known or later developed for any lawful purpose, including promotional, advertising, broadcast, and commercial uses, without compensation.

COMMERCIAL AND RESALE RESTRICTIONS

Tickets may not be used for advertising, promotions, contests, sweepstakes, hospitality packages, or other commercial purposes without APP’s prior written consent. Tickets may not be resold except through authorized channels designated by APP and in compliance with applicable law. Unauthorized resale or transfer may result in cancellation without refund.

Ambush marketing, unauthorized sponsorship activation, or any activity intended to create a commercial association with the Event without APP approval is strictly prohibited.

CODE OF CONDUCT AND SECURITY

Holder agrees to comply with all Event rules, policies, and instructions. Holder consents to reasonable security screening, including bag inspection and metal detection, and waives claims arising from such screening.

Prohibited items and conduct may include, without limitation: weapons, drones, professional cameras (other than mobile devices), outside alcohol, illegal substances, disruptive behavior, abusive language, harassment, interference with play, or violation of Event policies. Violators may be removed without refund and may be subject to legal action.

Holder is responsible for the conduct of any minors or guests accompanying them.

PARKING AND PROPERTY DISCLAIMER

Use of parking facilities is at Holder’s sole risk. The Released Parties are not responsible for theft, loss, or damage to vehicles or personal property.

GENERAL TERMS

This ticket is a revocable license and not a property right. Any rights not expressly granted herein are reserved by APP. APP reserves the right to modify these terms at any time, with updated terms effective upon posting. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
